1. Agreement to Terms
These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Safe and Sealed ("we," "us" or "our"), concerning your access to and use of the website as well as any related consultancy services.
You agree that by accessing the site and using our services, you have read, understood, and agree to be bound by all of these Terms of Service.
2. Professional Services
Safe and Sealed provides health and safety consultancy, CDM advisory, fire risk assessments, and Legionella risk assessments. While we strive to ensure that all advice and documentation provided complies with current UK legislation and best practice, the ultimate responsibility for health and safety compliance rests with the employer or duty holder.
Our advice is based on the information provided to us by the client. We cannot be held liable for omissions or inaccuracies resulting from incomplete or false information supplied by the client.
3. Intellectual Property Rights
Unless otherwise indicated, the website and all bespoke documentation, policies, reports, and RAMS provided as part of our services are our proprietary property. You are granted a licence to use these documents internally within your organisation for their intended health and safety purposes.
You may not resell, reproduce, distribute, or publicly display our proprietary documentation without our express written permission.
4. Fees and Payment
Fees for our services will be agreed upon in writing prior to the commencement of any work. Unless otherwise stated, all invoices are payable within 30 days of the invoice date.
We reserve the right to suspend services or withhold final documentation and reports if payment is not received in accordance with the agreed terms.
5. Limitation of Liability
In no event will Safe and Sealed, its directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages arising from your use of the site or our services.
Our total liability in respect of any claim arising out of or in connection with the provision of our services shall be limited to the fees paid by you for the specific service from which the claim arises.
6. Governing Law
These conditions are governed by and interpreted following the laws of England and Wales. Safe and Sealed and yourself both agree to submit to the non-exclusive jurisdiction of the courts of England and Wales.
